The text of the criminal complaint urgently raised to Mr. Attorney General of the International Criminal Court in The Hague - Netherlands – from the Yemeni civil society organizations and it contains the request to open international investigations in all the terrorism crimes that took place in Yemen and most recently the Crime of Genocide to employees of the Central Security in the seventy meter field in the capital Sana'a on May 21, 2012m. Subject: - "Request for an international investigation in all the terrorism and extremism crimes that have taken place in Yemen.
The civil society organizations signed below present you purer greetings and wish you continued success in your work, and has the honor to forward to you its above complaint because you are the competent authority, based on the provisions of the Rome Statute for the establishment of the International Criminal Court, and asks you to accept this complaint and initiating to open international investigations in all terrorist crimes that have occurred in Yemen, based on the provisions of the international humanitarian law and international conventions and treaties, and regional and national legislations,,,.
And the Yemeni civil society organizations establish its request and its above complaint based on the following grounds and reasons and justifications: -
1 - The increase in activity of terrorist offenses, led by "al-Qaeda terrorist in the Arabian Peninsula" in most areas of Yemen, and therefore the continuation of the fall of hundreds or even thousands of innocent civilians, and the new areas controlled by this terrorist international organization elements, daily and non-stop, where this terrorist regulation adopted its responsibility for most of the crimes of murder and extermination of hundreds and thousands of innocent civilians and killing of women and children and members of the Yemeni army and systematically and continuously, without stopping, in addition to its responsibility for committing the most heinous violations of other human rights committed by elements of the organization of terror against civilians in areas controlled by them in Yemen, the reason for the increased activity and the size of the terrorist organization al-Qaeda in Yemen is to several factors, most notably the enjoyment of the elements of this terrorist organization of security and impunity and the weak mechanisms for effective prosecution, as a natural result of the terrorists to take advantage of the Yemeni political crisis and chaos, that reflected itself on the Yemeni judiciary which is fully in a state of paralysis and weakness towards the crimes of terrorism in particular, and therefore unable to track down and follow the gangs of terrorists and bring them to justice, and perhaps the last terrorist crimes of al Qaeda in Yemen is a crime of genocide atrocities committed by al-Qaeda in the Arabian Peninsula, which killed about 100 men and wounding nearly three hundred people, all of whom are members of the Central Security Forces and the Yemeni army while they were in the middle of the seventy meter field in Sana'a on May 21 while they were doing rehearsals for the purpose of the military parade to celebrate the national Day of Yemen on May 22, and it is a massacre was condemned by the whole world.
2 - - Most of the investigations and preliminary information held in all the crimes of terrorism, and the former crimes that took place in Yemen - proved definitely - the participation and involvement of well-known Yemeni leaders that are accused of participating, incitement and funding for al-Qaida in the Arabian Peninsula, which receives material and moral support from some countries and foreign organizations, as demonstrated - as proven - they all contribute to the formation and management of cross-border terrorist gangs that are accused of terrorist offenses in Yemen and the world and for their own illegal investment, which means that the crimes of terrorism that have taken place in Yemen are large and global, and hold an international and local terrorist nature, and therefore will be difficult - even impossible – for the Yemeni judiciary, especially in light of the current situation - and for the foreseeable future - to achieve justice for the victims of terrorism or to consider the circumstances of the crime gangs of international terrorism individually and in its potential and capacity of vulnerable groups, in addition to its clear lack of experience and qualification and because it never experienced such terrorist crimes of international trans-boundary in terms of size, type, or internal and external link, as is the case in its inability from viewing the terrorist crime attack on the presidential mosque of Yemen in the June 3, 2011, where it could not take any legal action effectively so far, - and in our view - will not be able to work anything in the future both in this terrorist crime or other, for several reasons and the challenges facing it including technical and realistic challenges, as there is no room to talk about now, despite the fact that this terrorist crime has represented the strongest flagrant violation of the peace and security on international, regional and local levels by the terrorist forces that carried out or participated in it, where the international community as a whole for the first time in its history to condemn and denounce this crime, the international consensus uninterrupted occurrence, and even described this terrorist act as serious and under the UN Security Council Resolution number "2014" about Yemen ..
3 - The approval of Your Excellency for the request of the Yemeni civil society organizations, to open international investigations in all the terrorism crimes in Yemen is not considered an assault on the domestic sovereignty of Yemen as may also explained by some who do not agree to this, but it would be an intervention necessary to save Yemen "people and State," which suffers from the case of drowning in the swamp of terrorism, international and domestic that they face and are beaten by it every day and everywhere while the world watches it all, as it is exposed to the most heinous crimes of genocide of human race by gangs of al-Qaeda terrorist, and thus the issuance of this international resolution will be to ensure the achievement of international peace and security, regional and local, as this is at the heart of your legal expertise provided for under Chapter VII of the Charter of the establishment of the United Nations, as it would be to ensure an adequate and effective implementation of international resolutions issued on Yemen and specifically will be to implement the text of the second recommendation of the report of the delegation of the High Commissioner for Human Rights visit to Yemen on December 20 to December 27, 2011 and approved by all the international parties including the Government of Yemen and in session 19 of the Human Rights Council session held in March 2012 in the city of Geneva, where it is provided in the second recommendation: - " to open - and to encourage the opening – of an international investigation into the most" terrorist " heinous crimes that occurred during the crisis in Yemen , as well as the issuance of this decision will serve as a reaffirmation of international commitment to the international community to supervise the implementation of the provisions of the Gulf initiative and its operational Mechanism signed by all parties to the conflict of Yemen in Riyadh by the end of 2011, to end the crisis and bring peace in Yemen, which provided for the exception of crimes of terrorism of any national reconciliation to come, and consequently the formation of the court on terrorism will be the implementation of the state of national consensus and signed commitments and binding between all the local parties, and will be a sufficient guarantee for the achievement and the return of security, stability and peace in Yemen, as well as at regional and international level, as it will reflect the extent of solidarity and partnership of the international community with Yemen in the fight against terrorism through its participation in creating a judicial mechanism, common and effective way to track and trace the activities of all the terrorists involved in all the crimes of terrorism (whether local or international) and bring them to justice and to ensure that no impunity
The Yemeni civil society organizations, below appeals to you to see the request and justification for the above, and is waiting for positive response with appeals to save the security and stability and the unity of Yemen through the speed into international judicial investigations in all the crimes of terrorism that took place in Yemen for what is mentioned of justification and the reasons above, as this decision would be the best mechanism for effective international and national and joint counter cross-border terrorism and to ensure international and local effective partnership in the pursuit of terrorists involved around the world and ensure that no impunity, and so as not to sink Yemen in the swamp of terrorism while the international community watching it.
